The caregiver sponsorship program process:
Our agency proudly sponsors qualified caregivers seeking permanent employment in the United States through the EB-3(c) immigrant visa category, also known as the “Other Workers” classification. This program provides a pathway to lawful permanent residency (a green card) for caregivers who meet eligibility requirements and complete the federal immigration process.
This page explains the process, your responsibilities, and the expected timeline from sponsorship to green card issuance.
As a participating caregiver, you will be sponsored for permanent, full-time employment by our agency. Sponsorship means that we, as the employer, petition the U.S. government to confirm that:
- There is a legitimate, full-time caregiver position available;
- The offered wage meets federal prevailing wage requirements; and
- There are insufficient able, willing, qualified, and available U.S. workers for the role.
This sponsorship is the foundation of the EB-3(c) immigration process.
While our agency serves as the employer-sponsor, each caregiver is responsible for retaining and paying their own immigration attorney to process the visa and handle the required immigration filings.
After you are accepted into our sponsorship program:
- You will be provided with the contact information for the immigration attorney handling EB-3 caregiver cases associated with our program.
- You must personally contact the attorney’s office to schedule an initial consultation.
- During that consultation, the attorney will review your eligibility, explain fees, and outline the legal process.
- You will enter into a separate attorney-client agreement directly with the attorney.
Please note that the attorney represents you individually in immigration matters, even though the employment sponsorship is through our agency.
The first major step in the EB-3(c) process is called PERM Labor Certification, which is filed with the U.S. Department of Labor.
This stage includes:
- Prevailing wage determination;
- Mandatory recruitment and advertising for U.S. workers;
- Review of applicants (if any); and
- Filing of the PERM application with the Department of Labor.
Estimated timeframe for PERM:
Approximately 10 to 14 months on average, though processing times may vary based on government backlogs, audits, or recruitment requirements.
If the PERM application is audited, additional time may be added.
Once the PERM Labor Certification is approved, the next step is filing Form I-140 (Immigrant Petition for Alien Worker) with U.S. Citizenship and Immigration Services (USCIS).
This petition confirms:
- The employer’s ability to pay the offered wage; and
- The caregiver’s qualifications for the position.
Estimated timeframe for I-140 processing:
- Standard processing: ~6 to 10 months
- Premium processing (if available and selected): ~15 business days
EB-3(c) visas are subject to annual quotas and country-of-birth backlogs.
After I-140 approval, caregivers must wait until their priority date becomes current under the U.S. Department of State Visa Bulletin.
Estimated wait time:
- Varies by country of birth
- Typically 1 to 3+ years for EB-3 Other Workers
Your attorney will monitor visa availability and advise when you may proceed.
When the priority date is current, caregivers complete the final stage:
- Consular Processing (if outside the U.S.), or
- Adjustment of Status (if lawfully inside the U.S., if eligible)
This stage includes:
- Medical examination
- Background checks
- Submission of civil documents
- Visa interview (if applicable)
Estimated timeframe:
~8 to 12 months
From PERM filing to green card issuance, the overall process generally takes:

Processing times are government-controlled and subject to change
As a sponsored caregiver, you are responsible for:
- Retaining and paying your immigration attorney;
- Complying with the terms of your caregiver contract;
- Providing all requested documents promptly;
- Completing forms and applications accurately;
- Attending scheduled consultations and interviews; and
- Maintaining communication with the attorney throughout the process.
Failure to timely cooperate with your attorney may delay or jeopardize your case.
